STATEMENT OF RELEVANT FACTS
- For the past 11 years, I and my children have been emotionally tortured and had our fundamental rights systematically deprived by the State of New Mexico, Bernalillo County, the City of Albuquerque and the Hubka family .
- It all began in April of 2013 when Defendant Linda Johnson-Hopkins, the adoptive mother of my eldest child’s father, began calling CYFD and making false allegations against me. Linda had become obsessed with my child’s father since he had died in a violent incident between him and a friend in 2007.
- Being a caring individual, I used to take the children to visit Johnson-Hopkins every summer until one day my daughter said she did not want to go back because, “Grandmom was talking about taking custody of her.”
- Driven by an obsession to hold on to a piece of her deceased son by taking custody of my children, Johnson-Hopkins began conspiring with CYFD by calling in false allegations against me and encouraging her sister Helen Smith, her niece, Marlena Johnson, and her other niece, Jamiesha Johnson to collectively call DCFS everyday until they got the children taken away from me.
- As a result of the telephone campaign, on April 30, 2013 around 10:30 am, a CYFD social worker investigator by the name of Andrea Gonzalez, showed-up unannounced at my home at 2905 Chelwoopark Apt B Albuquerque to investigate me.
- During that time I was about 7 months pregnant.
- She sat down and said that she received information from the Johnson-Hopkins family that:
- I did all types of drugs, and;
- I was neglecting my children, and that
- I choked them, and;
- They always went to school hungry, and;
- I was feeding my 2 children at the time dog poop, and;
- I beat my kids and left them alone often.
